Documents You Need to File Chapter 7 Bankruptcy: A Complete Checklist

Filing for Chapter 7 bankruptcy is a major step toward financial relief—but before you begin, you'll need to gather the right documents. Having everything organized in advance will make the process smoother, more accurate, and less stressful.

Here’s a complete checklist of the documents and information you’ll need before filing Chapter 7 bankruptcy.

1. Proof of Income

The court requires a full picture of your income to determine eligibility and assess your financial situation.

Collect:

  • Pay stubs or wage statements for the past 6 months

  • Bank statements (some trustees require up to 12 months)

  • Proof of any other income (bonuses, commissions, side jobs, alimony, rental income)

  • If self-employed: Profit and loss statements, invoices, and business records

2. Tax Returns

You must provide copies of your federal and state income tax returns.

Collect:

  • The last 2 years of filed tax returns (some trustees ask for up to 4 years)

  • Proof of any unfiled returns and efforts to resolve them

If you haven't filed your returns, you'll need to do so before filing for bankruptcy.

 

3. List of Debts (Creditors)

You must list all of your debts—even those you hope to keep paying.

Gather:

  • Credit card statements

  • Medical bills

  • Collection letters

  • Loan agreements (personal loans, auto loans, payday loans)

  • IRS or state tax notices

  • A copy of your credit report (from all 3 bureaus: Equifax, TransUnion, Experian)

Tip: Your bankruptcy attorney may pull a credit report for you to ensure no creditor is missed.

4. Asset Information

You’ll need to disclose everything you own, even if it has little or no value.

Collect:

  • Deeds to real estate (home, land)

  • Mortgage statements

  • Vehicle titles and registration

  • Retirement accounts (401(k), IRA) and statements

  • Bank account balances

  • Life insurance policies (with cash value)

  • Appraisals or estimated value of major assets (jewelry, electronics, tools, furniture, firearms, etc.)

  • Business ownership documents

5. Monthly Expenses and Budget

The court requires a breakdown of your regular expenses.

Document:

  • Rent or mortgage

  • Utilities (electric, water, gas, internet, phone)

  • Food and groceries

  • Transportation (gas, car maintenance, insurance)

  • Childcare, tuition, medical expenses

  • Insurance premiums

  • Any other monthly obligations

 

6. Identification Documents

You’ll need valid forms of ID to verify your identity at the Meeting of Creditors (341 Meeting).

Provide:

  • A government-issued photo ID (e.g., driver’s license or passport)

  • Your Social Security card (or a W-2 showing full SSN)

7. Marital and Household Information

Even if you're filing individually, the court needs to understand your full household situation.

Prepare:

  • Marriage certificate (if applicable)

  • Divorce decree or separation agreement (if separated or divorced)

  • Income documentation for your spouse (if married)

  • List of dependents and their ages

8. Court Records (if applicable)

If you're involved in any lawsuits, judgments, or legal actions, these need to be disclosed.

Include:

  • Lawsuits or judgments against you

  • Garnishment orders

  • Divorce or custody proceedings

  • Past bankruptcies (case number and filing date)

9. Credit Counseling Certificate

Before filing, you must complete a pre-bankruptcy credit counseling course from an approved agency.

You'll receive a certificate of completion, which must be filed with the court.

⚠️ This course must be completed within 180 days before you file.

Optional: Other Helpful Documents

  • Lease or rental agreements

  • Child support or alimony orders

  • Student loan documents

  • Medical bills and insurance EOBs

  • Documentation of recent major purchases or transfers (within the last 2 years)
